Sir,
I have the honour to inform you that an
application is about to be made to the Judicial Committee
of the Privy Council for leave to appeal in forma pauperis
on behalf of one Ng Loi Yuen alias Ng Yik San who was
convicted by a special Jury on the 7th September, 1934, of the murder of Michael Pine, a child of eight years,
on the 22nd June, 1934, and was sentenced to death. An
appeal to the Full Court on questions of law was dismissed
on the 17th October, 1934.

I considered the case in my Executive
Council on the 8th November and confirmed the sentence.
In view, however, of the application to the Privy Council
I have since decided to respite the sentence for four
months from the 17th October, 1934, in order to allow
time for the application to be heard.

If leave be granted, I would request
that solicitors be engaged and Counsel retained to
